Lost Wages Claims in Illinois

Wage benefits are available on a temporary or permanent basis, depending on the category of disability you fall under. The four general categories include:

Temporary Partial Disability (TPD): This benefit is available temporarily for workers that have work restrictions or reduced hours which result in a lower wage than they were previously receiving. TPD benefits amount to two-thirds of the difference between the average weekly wage for the 52 weeks prior to the illness or injury, and what they are currently receiving (subject to certain minimum and maximum limitations). Temporary Total Disability (TTD): This benefit is available to workers who are totally disabled and unable to perform any work for a temporary period of time, such as while receiving medical treatment or during rehabilitation. TTD benefits amount to two-thirds of the worker's average weekly wage for the 52 weeks before the illness or injury (subject to certain minimum and maximum limitations).

Permanent Partial Disability (PPD): This benefit is available to workers who have a partial disability that permanently restricts their ability to perform their work or permanently necessitates a reduction of hours. Permanent loss of use of one body part automatically qualifies a worker for PPD status. Benefits paid are dependent on several factors, such as which body part was injured, the percentage of loss of use of the injured body part, and the worker's average weekly wage. Benefits are subject to certain minimum and maximum limitations.

Permanent Total Disability (PTD): This benefit is available to workers that have suffered from a work-related illness or injury and are unable to ever return to gainful employment. Permanent loss of use of two or more body parts automatically qualifies a worker for PTD status. Those who qualify receive a lifetime benefit of two-thirds of their average weekly wage (subject to certain minimum and maximum limitations).
